The Division of Employment Security allowed plaintiffs claim for unemployment compensation. Upon the employers appeal, an Appeal Tribunal, after hearing, found that it did not appear that plaintiff was "available for work" as required by R.S. 43:21-4(c) and therefore held him to be "ineligible" for benefits. The Board of Review, on plaintiffs appeal, reviewed the Appeal Tribunals decision on the record made before that body, reversed it, and allowed the claim. The employer appealed to the Superior Court, Appellate Division, which sustained the Board of Review. 24 N.J. Super. 277 (1953). We allowed certification on the employers petition. 12 N.J. 351 (1953).
